I am not a drug user or an alcoholic, gambler, or a scammer. This is for real, my brother was living in my house and was suppose to pay the mortgage while i lived in a low income apt in another city bc the schools here r horrible, am homeschooling now, since we moved back to home. As for equity, i dont no, my dad died 6 yrs ago but havent had $ to put house in my name. It takes an act of congress to get the bank to talk to me sumtimes, bc its not in my name. I have faxed them the will and power of attorney, but they still sumtimes wont talk to me. Thats one reason its behind, my bro was living here, stopped paying and the bank wasnt talking to me, they wud call my bro at the address, bc his last name is still same as dads i guess, mine is not. By the time I found out it was several months, then had to file eviction, and take months to get place livable. By that time I was working w the loss mitigation dept of bank, told them what happened they said wudnt foreclose, then I find out from a family friend my house is in the paper up for auction on 4/16/12. I called the bank again, spoke to loss mitigation dept, foreclosure dept, and the attorney that holds the contract for auction. My disability isnt the problem, I can make the payments, its the past due and fees from last yr that I cant pay by then. Its prob going to b around 3500. w their attorneys fees. As far as my credit, its not good, when I was pulled out of work, while waiting for disability, all my credit went south. The bank is saying only way to stop it is to make it current. For my family, they dont have the $ either, live pay check to pay check. As for the house, its not fancy or big, but its our home, it was refinanced in 2003, so dont no if it has equity, prob not much, if any.
I was wondering about bankruptcy, wasnt sure if it wud cover it with the will, poa, and if I file a quick claim deed. My dad died in 06, I was told it doesnt have to go thru probate bc
had a will. Dont have $ to do it anyway.
