My uncle passed away a couple weeks ago. One of my cousins is the executor of the will. I am one of the few people named in the will.
We (my family and I) were told that we’d have to wait a few months for probate before we see the will.
Everyone’s fairly certain that my uncle’s house and truck were left to my cousin, who is the executor, BUT we know for a fact that he is already driving the truck and going through the house looking for money and valuables. We know this because he came to our house in the truck to discuss the will with us initially and told us he was looking for the money and valuables to help pay for the funeral.
I asked him how it was that he was doing these things if the will hadn’t gone through yet, and he laughed and said “Because I have the keys!”
Is this illegal, whether or not these things are in the will for him?
If so, should we report him?
If so, what could happen to him?
