I am going to court tomorrow to file a motion to dismiss but I do not know anything about doing this. The reason I am filing a motion to dismiss is because I filed a complaint for modification to request permission to move out of state with my child. I thought I needed permission to move out of state with my child but I was wrong. The free legal aide that helped me do this screwed me all up.
I have sole, physical, legal custody of my child and I was told that I could move wherever I wanted to whenever I wanted to. The free legal aide that helped me even used a temporary order to help me file this motion as opposed to using the actual judgment (Bad Mistake here.) I received a court date for July however I need to move much earlier than this. The person that helped me failed to recognize the distinction in the laws that applied to wed and unwed mothers. I can’t believe this.
Can you tell me how this motion to dismiss works?
Will my case be dismissed right away? Do I have to wait for someone to approve it? Is there a fee?
