Open Question: can a probate judge demand to see the accounting for trust assets?

February 27, 2012 by Anthony Nitz

My accountant was hired to produce a “Final Accounting” of an estate that’s been open for 10 years. The judge ordered me to account for all of these estate assets, NUMEROUS times. Over the years most of it was transferred into a trust, but some was un-accounted for. I had to get old bank statements to track these down and its taken years. The accountant was instructed to contact a special fiduciary who has assumed control of the estate 2 years ago.

The accountant delayed producing the report, in fact was fired and then re-hired. I sat down with him and went over the whole thing including the trusts, he keep insisting that the judge was only interested in the assets still in probate, but we went through everything and HE was satisfied that I was honest and nothing was missing, and he even made some recommendations as to the money split-up if the trusts were closed today. felt he knew what he was doing, but the report was still delayed. The special fiduciary was removed
